Terms of Services

Introduction

Welcome to Enfrasys, a company based in Malaysia that provides Cloud Services, Managed Services, and Licensing Services (the “Company”). Our services include the provision of cloud computing resources, managed IT services, and software licensing (the “Services”). By using our Services, you agree to be bound by these terms of service (the “Terms”). If you do not agree to these Terms, you may not use our Services.

Service Description

Our Services allow you to store, process, access data and software via the internet, as well as access and utilize managed IT services and software licenses. We will use reasonable efforts to make the Services available 24 hours a day, 7 days a week, except for planned downtime and any unavailability caused by circumstances beyond our control, such as force majeure events or acts of government.

Your Responsibilities

You are responsible for ensuring that your use of our Services complies with all applicable laws and regulations, including data protection and privacy laws, and that the licenses obtained are used in accordance with the terms and conditions of the licensor. You will also be responsible for maintaining the security of your account and any data stored or processed through our Services.

Data Protection

We will process any personal data you submit through our Services in accordance with our Privacy Policy and applicable data protection legislation, including the Personal Data Protection Act 2010 of Malaysia (PDPA). We will not disclose your personal data to third parties without your consent, except as required by law or for the purposes set out in our Privacy Policy.

Payment and Billing

You will be charged for the Services in accordance with the pricing and payment terms set out in your contract with us. We may change the pricing and payment terms for the Services at any time, but we will provide you with reasonable notice of any such changes.

Termination

You may terminate your contract with us at any time by providing written notice. We may terminate your contract if you breach these Terms, failure to make payments or if we discontinue the Services.

Disclaimer of Warranties

The Services are provided “as is” and “as available”. We make no representations or warranties of any kind, express or implied, as to the operation of the Services or the information, content, materials, or products included on the Services. We do not warrant that the Services will be uninterrupted or error-free, and we will not be liable for any interruptions or errors.

Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Services or these Terms.

Governing Law and Jurisdiction

These Terms and your use of the Services will be governed by and construed in accordance with the laws of Malaysia, without giving effect to any principles of conflicts of law. Any disputes arising out of or in connection with these Terms or the Services will be subject to the exclusive jurisdiction of the courts of Malaysia.

Miscellaneous

These Terms constitute the entire agreement between you and us regarding the use of the Services. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision in these Terms will not be deemed a waiver of such right or provision unless acknowledged and agreed to by us in writing.
